A New York judge delayed sentencing in Donald Trump’s hush money case and allowed the president-elect to appeal to overturn the conviction before he takes office on January 20.
Judge Juan Merchan on Friday canceled the sentencing hearing scheduled for November 26 without setting a new date.
Both prosecutors and defense attorneys want to pause the trial in order to deal with an unprecedented legal situation: convicting an incoming president of a crime.
Merchan also ruled that Trump’s team could file a motion to have the case dismissed. Prosecutors say they will fight for the sentence to be overturned.
Trump was found guilty on May 30 of 34 counts of falsifying corporate records in connection with a hush money payment to porn star Stormy Daniels before the 2016 US presidential election.
