The Republican National Committee (RNC) has filed two new lawsuits in Pennsylvania after several state election boards voted to count multiple undated ballots following a state supreme court ruling on the matter.
The two suits involve Democratic incumbent Sen. Bob Casey refusing to enter a closely contested race against his GOP challenger, Sen. Elected Dave McCormick.
“Tonight the RNC is filing two new lawsuits – in Bucks County and the Pennsylvania Supreme Court – TO STOP the illegal vote counting. We have won this court battle many times,” GOP Chairman Michael Whatley tweeted on Wednesday evening.
“The RNC is petitioning the Pennsylvania Supreme Court to ensure that Pennsylvania’s democratic process is not undermined by the inclusion of illegal ballots in the final vote count,” Whatley said in a statement. “Pennsylvanians are ready to move forward with Dave McCormick in the Senate as Bob Casey lights out any legacy he has with these anti-democratic initiatives.”

Philadelphia City Commissioners told Fox News Digital in a statement that several Pennsylvania state election boards, including Philadelphia, voted to count “a small number of untimely and incorrectly dated mail-in ballots.”
“Republicans have filed a petition in the PA Supreme Court against all counties to try to block all counties from counting these votes,” the statement said. “They have also filed a formal complaint challenging Bucks County’s decision to count untimely mail ballots with an incorrect date. We are reviewing the filing.”
The Pennsylvania Supreme Court previously sided with the GOP in its bid to block early vote counting ahead of the 2024 general election.

“It’s ridiculous,” an RNC official told Fox News Digital. “The court just issued a decision on this two weeks ago. And it’s very clear to us that Democrat lawmakers and officials see a way to make money off of Bob Casey by trying this process, but Dave McCormick is already in DC to attend the Senate. “
Commonwealth Secretary Al Schmidt announced in a press release Wednesday that “illegal results in the November 5 U.S. Senate race” triggered an automatic statewide recount.
As of Wednesday, Casey received 3,350,972 votes (48.50%), while McCormick received 3,380,310 votes (48.93%), according to a press release.

Once counties have finished counting their votes, they must begin their recount no later than Wednesday, September 20 and finish by November 26 at noon. Results reports should then be submitted to the secretary by noon on November 27.
The Pennsylvania Supreme Court’s ruling overturned a U.S. Court of Appeals ruling just days before the Nov. 5 election, which held that a state law requiring a handwritten date was unconstitutional. The Pennsylvania GOP appealed that decision to the state’s highest court.
Pennsylvania Republicans applauded the decision at the time, saying Democrats had repeatedly tried to undermine the dating requirement.

“The Pennsylvania Supreme Court upheld the law, and the dated ballot requirement will apply to this election. Democrats have tried repeatedly to eliminate this important voting protection, and we have stopped them every time,” Whatley said in a statement at the time. .
